Terms & Conditions of Service


1. Introduction


Welcome to somewherepartyroom.com, powered by Schwifty Technology Company (referred to as “Schwifty”). The terms “Company” and “Channels” collectively refer to the Sites, Platforms, and Applications operated by Schwifty.


By using the Channels, you agree to the Privacy Policy and these Terms and Conditions. If you don’t accept them, please refrain from using the Channels. We may update these terms without prior notice, and your continued use signifies your acceptance.


2. General Terms


Our Channels offer various services, including but not limited to comments, activity information, reservations, voucher sales, advertising, and more (collectively, “Services”). We can modify or remove content, but we are not party to any transactions between users.


We respect user privacy, and our use of your information is governed by our Privacy Policy.


3. Registration as Member


To access certain features and our Reward Scheme, you must register as a Member. Ensure accurate registration information. We’re not liable for improper use of your username or password, and you’re responsible for maintaining their confidentiality. Notify us of unauthorized use.


We may refuse registration requests and reserve the right to deactivate or cancel accounts as needed.


4. Prohibited Uses


Users must not interfere with our Channels’ security, delete or revise others’ content, infringe on copyrights or personal rights, engage in illegal activities, spam, or access others’ personal data without permission. Users can’t transfer their rights or obligations under these Terms without our consent.


Members should not share their login credentials.


5. Acceptable Uses


When contacting service providers through our site, you enter into a contract with them. We haven’t vetted these providers and make no endorsements. We’re not liable for their actions or services.


Users posting content (“Posting Users”) should use our Channels for lawful purposes. We reserve the right to manage and remove materials as needed. Posting Users are responsible for their content, and we can terminate services at our discretion.


6. Advertising and Commercial Content


Advertisers or Merchants can post advertisements and promotional materials. The use of our Channels for this purpose is subject to a Service Agreement. We reserve the right to modify service fees.


7. Entertainment Activity Reviews


Users posting reviews of entertainment activities should follow our guidelines and should not receive compensation for writing or removing reviews.

8. Viewer Content and Modification:

The Company can modify site content and terms at any time, effective immediately upon posting. Viewer(s) agree to lawful use of Channels and personal data.


9. User Booking Services:

Users of the Booking Service acknowledge and accept the Terms of Booking. The Company collects and uses personal information in line with the Privacy Policy.


10. Voucher Purchases:

Only Members or authorized Third Party Platforms users can purchase vouchers. Users must accept Terms of Voucher Purchase or Third Party Platform terms.


11. Merchant Services:

Merchants using the merchant service system agree to the Terms and Conditions, Terms of Merchant Services, and relevant agreements with the Company.


12. Content License:

By posting Materials, Users grant the Company rights to use and distribute those Materials.


13. Intellectual Property:

Channel content is protected by copyright and trademark laws. Unauthorized use is prohibited.


14. Content Responsibility:

The Company doesn’t pre-screen content. Users are responsible for their posted Materials and any linked third-party content.


15. Termination and Indemnity:

The Company may terminate or remove Materials. Users indemnify and hold the Company harmless.


16. Limitation and Termination of Service:

The Company may limit Services and delete or deactivate accounts without notice.


17. Disclaimer:

The Company isn’t responsible for inaccurate listings or service interruptions. It doesn’t guarantee continuous access to Services.


18. Limitation of Liability:

The Company’s aggregate liability is limited to HK$100.


19. Security Measures:

The Company will protect personal data and follow its Privacy Policy.


20. Severability:

If one provision is invalid, it won’t affect the others.


21. Conflict:

In case of conflict among documents, the latest takes precedence.


22. Governing Law and Dispute Resolution:

Any disputes will be settled by arbitration according to HKIAC rules, with the place of arbitration being Hong Kong.


23. Rights of Third Parties:

Only the parties to these terms can enforce them.


24. Inconsistency:

The English version prevails in case of inconsistencies.
